Terms of Service

1. Introduction

Welcome to Atrinity Technologies. These Terms of Service ("Terms") govern your use of our website, services, and any software or applications provided by Atrinity ("we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms.

If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

2. Our Services & Packages

Atrinity offers various service packages tailored to different business needs:

Website Development Packages

  • Basic Plan (₹5,000 - ₹15,000): Single-page static websites with optional add-ons
  • Standard Plan (₹20,000 - ₹35,000): Dynamic websites with admin dashboard and database integration
  • Advanced Plan (₹40,000 - ₹90,000): Full-featured web applications with CMS, payment integration, and advanced functionality

Software Packages

  • Starter Package (₹30,000 - ₹50,000): Lightweight, offline-first desktop applications
  • Standard Package (₹70,000 - ₹1,20,000): Multi-user systems with cloud connectivity and role-based access
  • Enterprise Package (₹1,50,000+): Complex, business-critical applications with real-time features and integrations

3. Payment Terms

All projects follow a structured payment schedule:

  • Booking Fee (10%): Paid at contract signing to confirm the project. This fee is non-refundable.
  • Design Approval Stage (50%): Payable once design mockups are approved. Development begins only after this payment.
  • Final Payment (40%): Payable upon delivery of the final product. Must be cleared before handover.

No website, software, or source code will be delivered until full payment is received. All fees are exclusive of GST and other applicable taxes.

4. Scope of Work & Revisions

The scope of work is defined in the signed project proposal. We include:

  • Up to 2 rounds of revisions per deliverable (design, module, feature)
  • Bug fixes for delivered features during the warranty period
  • Changes or new feature requests after scope lock are treated as new work and billed separately

Once the development phase begins, no design changes will be accepted. Any design changes requested after development starts will be treated as additional paid work.

5. Delivery & Acceptance

Estimated delivery timelines:

  • Website Development: 3-18 business days depending on package complexity
  • Software Development: 15-120 working days depending on package

Timelines are estimates and assume timely client input (content, feedback, approvals). Client delays will extend timelines accordingly. Client must review deliverables within 14 days of delivery. Lack of response counts as acceptance.

6. Client Responsibilities

The Client agrees to:

  • Provide all website content (text, images, videos) in a timely manner
  • Guarantee legal rights to all content provided
  • Provide necessary credentials, API keys, and approvals per project timeline
  • Cover third-party costs (domain, hosting, paid plugins, stock images, etc.)

We are not responsible for delays caused by late or incomplete content submission.

7. Ownership & Intellectual Property

All deliverables remain our property until full payment is received. Once fully paid:

  • Client owns the final software and compiled files
  • Source code ownership is transferred only if specified in the contract
  • Client is responsible for licensing of any content, fonts, APIs, or data provided

Developer Credit: Our credit (e.g., "Website by Atrinity") must remain visible on the website and cannot be removed as long as the Client is using our design.

8. Maintenance Plans

After project delivery, we offer maintenance plans to keep your system running smoothly:

Tier 1: Basic (₹5,000/month)

Bug fixes, minor UI/text changes, basic server monitoring, 72-hour response

Tier 2: Growth (₹15,000/month)

Up to 2 minor features/month, priority bug fixing (48-hour response), quarterly performance review

Tier 3: Enterprise (₹25,000-40,000/month)

Up to 3 major or 5 minor features/month, advanced feature maintenance, custom integrations, 24-48 hour priority response

9. Cancellation & Refunds

  • Booking Fee (10%) is strictly non-refundable
  • If client cancels after design approval, the 50% design payment is retained for work completed
  • If client cancels during development, all work done up to cancellation remains billable
  • If we cancel or fail to deliver, a fair refund will be issued for undelivered portions
  • Either party may terminate maintenance with 30 days' written notice

10. Confidentiality

Both parties agree not to disclose any confidential or proprietary information related to the project, business operations, or technical processes without written consent. We may showcase the final product in our portfolio unless otherwise agreed in writing.

11. Promotion Rights

We retain the right to display the project in our portfolio, social media, and marketing materials for promotional purposes. This includes posting screenshots, links, and descriptions of the project. This does not grant permission to modify the live website for promotional purposes.

12. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for third-party service failures (APIs, hosting, payment gateways)
  • We are not responsible for misuse, mismanagement, or unauthorized modifications after delivery
  • Maximum liability is limited to the total amount paid by the client for the project
  • We are not liable for any indirect, incidental, or consequential damages

13. Third-Party Costs

The following costs are not included in project fees and must be paid directly by the Client:

  • Domain registration and renewal
  • Hosting services (Vercel, Netlify, AWS, etc.)
  • Paid plugins, premium fonts, stock images
  • External APIs and third-party subscriptions
  • SSL certificates (if not included with hosting)

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of our services after any changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Jalandhar, Punjab.
